Given the current economic situation, we are increasingly asked about insolvency and the liquidation process.
There are three main types of liquidation:
- Creditors Voluntary Liquidation
- Court Liquidation
- Members Liquidation
By far the most common type of liquidation used in Ireland is the Creditors Voluntary Liquidation, whereupon the directors voluntarily place the company into liquidation.
A resolution is passed by the members of the company to place the company into liquidation and a meeting of the creditors is called to present the Directors statement of affairs, at the creditors meeting, the creditors have the choice to approve the Directors nomination for liquidator or to appoint their own liquidator.
