Irish solicitor or Conflict of Interest

See a pic before you read.

Demand …

Low and behold, didn’t she get a letter from the same (her) solicitor,

warning and threatening her that they would take her to court if she

didn’t pay up a demand made by the local County Council.

Conflict of Interest …

Obviously this is a clear “Conflict of Interest” by the solicitor.

This could or may also lead the solicitor into allegations of a

more serious nature. This would also bring into question about

the application and validity of the data protection act 2003.

More equal than others …

Given that the data protection commissioner gives exemption,

for some unfathomable reason to solicitors acting on behalf of

Corporations like Banks and County Councils etc. Giving rise to

the idea that “Some are more equal than others”.

Solicitors are Special.

According to the data protection commissioner, no person can

have or hold data about you, without your consent, unless they

are a solicitor! Solicitors get a very special exemption!

Facilitate fraud …

Even if the data protection commissioner does facilitate the fraud

that goes on under their own data protection rules, it still does NOT

mean that by LAW (solicitors) are exempt. Very much like the LAW

of gravity, eventually we all succumb to it, and end up in the earth.

Contract LAW!!!

There is a thing in Contract LAW called “Privity of Contract”. It is a

fundamental tenet of Contract LAW; although a solicitor may argue

that he can Contract or be an agent with or whom he or she may so

choose, therefore can assume rights to have your data … Under the

“Doctrine of Privity” in Contract LAW, they have NO RIGHT to assume

or presume to have or continue to have a Contract with You; especially

when You terminate the relationship. Sack them and point them to the

fact that they have no or any rights under “Privity of Contract”.

Privity of Contract … means Privacy of a Contract.

Assuming of course that a LAWful and binding Contract may exist.

1. Doctrine of Privity.

A contract is a private relationship between the TWO parties that

make it, and no other person (corporate entity) can acquire rights

or incur liabilities under it.

Arses from elbows …

In many cases, many solicitors just do not know the LAW, pertaining

to Contract. This is just one of the many reasons why solicitors are

really inept and redundant when it comes to defending clients.

Lost Revenue …

On the other hand, if they start LAWfully challenging Banks, Councils

& the myriad of Corporations out there that are taking the life blood

from you, they will and do get ostracised from the legal world. They

will start losing the all-important revenue stream. The so called law

society of Ireland have one soulless purpose, and that is to support the

members of their own club to make money from YOU and ME!

Collusion & Fraud by Solicitors with Council …

There may also be acts of collusion, fraud and possible criminal conversion,

leading to extortion and racketeering, which can or may result in a possible

prison sentence and a hefty fine for the solicitor(s) and any others involved.

Dilemma …

Sufficed to say; that because of the times that we currently live

in, hundreds of solicitors find themselves with this dilemma, of

whether or not to serve their client’s interests or their own self

interests. This is quite an understandable dilemma; but sufficed

to say, for many solicitors, that in the medium to long term, if

they continue to serve two masters, they will end up themselves

on the wrong side of the LAW and in prison.

Consider This …

If they do; Consider NOT doing business with them any longer. As you may

find that some-day, they will be threatening or harassing YOU, “their client”

for demands of all sorts, from a variety of nefarious corporate bodies.

Possibly:

Send this email on to the solicitor that you are using if you are unsure.

They can call me to discuss the LAW if they so wish. We can record the

call also, if they want to make sure that they have an accurate record …

This would also make for a very interesting TNS Radio Show interview.

Turn On & Tune In …

Tune in to www.TNSRadio.ning.com/ every Thursday night from 9pm,

for the Financial Frontline with Darrell and David. We discuss the LAW,

we discuss Contracts. We interview real people with real lives & stories,

and we seek real solutions for real problems.

Seeking Solutions …

Tonight we will review and discuss “Blank of Ireland … This Way Out!”.

One man’s method and process that legally and lawfully challenged the

Bank of Ireland, and led to the Bank dismissing or writing off the debt …
